Consignment / Import Agreement

Authorises Petrolex Auto Imports Limited to source, purchase, import and clear a motor vehicle on the customer's behalf, and sets out who pays what.

1. Authority. The customer authorises Petrolex to identify, bid for and purchase the vehicle described above up to the maximum bid authorised, and to arrange export, shipping, customs entry and delivery.
2. Agency. Petrolex acts as the customer's agent for sourcing and importation. The customer is the importer of record and is responsible for all statutory charges assessed on the vehicle.
3. Deposit. No bid is placed until the deposit is received and receipted. The deposit is applied to the landed cost. A successful bid cannot be cancelled: Japanese auction houses treat a winning bid as binding, and the deposit is applied against costs Petrolex has committed on the customer's behalf.
4. Auction outcomes. Bidding may be unsuccessful. Where no vehicle is secured, the deposit is refunded in full within thirty (30) days, or held for a further attempt at the customer's written election.
5. Condition and grading. Vehicles are bought on the basis of auction inspection sheets and photographs supplied by the auction house. Those are the grader's opinion. Petrolex passes them on in good faith and gives no warranty as to grade, mileage, accident history or mechanical condition of an auction vehicle.
6. Statutory charges. Duty, GCT, SCT, levies and port charges are assessed by the Jamaica Customs Agency on arrival, on values the authorities determine. Estimates above are indicative only; any shortfall is payable by the customer before release, and any overpayment is refunded.
7. Balance before release. The vehicle is released only when the landed cost, including all assessed charges, has been settled in cleared funds.
8. Shipping. Vessel, voyage, ETD and ETA are set by the carrier and may change. Petrolex posts milestones to the customer's online tracking record as they occur.
9. Insurance. Marine insurance covers total loss and specified perils only, on the CIF value, unless the customer arranges wider cover in writing before loading.
10. Demurrage and storage. Charges arising because the customer has not settled the balance or supplied required documents are for the customer's account.
11. Non-conforming vehicles. Vehicles that cannot be lawfully imported into Jamaica, or that fail statutory age or emissions requirements, are the customer's responsibility to establish before authorising a bid. Petrolex will advise known restrictions on request.
12. Governing law. This Agreement is governed by the laws of Jamaica.
