Motor Vehicle Rental Agreement

Between Petrolex Auto Imports Limited (“the Owner”) and the renter named below (“the Renter”), for the rental of the vehicle described below.

1. The vehicle may be driven only by the Renter and any additional driver named above, each of whom must hold a valid licence held for at least two (2) years and be at least twenty-five (25) years of age.
2. The vehicle must not be used: for hire or reward; to carry passengers for payment; to push or tow; in any race, rally or contest; off sealed roads; to carry goods in breach of law; or by anyone under the influence of alcohol or drugs.
3. The vehicle must not leave Jamaica and must not be sub-let or lent to any other person.
4. Fuel is supplied at the level recorded at check-out and must be returned at that level; otherwise refuelling is charged at cost plus the Owner's service fee.
5. Late return is charged at the daily rate per day or part-day, unless an extension is agreed in writing before the return time.
6. The Renter is liable for all traffic tickets, parking fines, toll charges and any related administrative fee incurred during the rental period.
7. In an accident, theft or damage the Renter must notify the Owner and the police immediately, must not admit liability, and must obtain the names and addresses of all parties and witnesses. The Renter remains liable for the insurance excess stated above, and for the full loss where a term of this Agreement has been breached.
8. Mechanical failure must be reported before further use. Repairs are authorised by the Owner only; unauthorised repairs are not reimbursed.
9. The security deposit is refunded within seven (7) business days of check-in, less any charges properly due.
10. Smoking in the vehicle attracts a cleaning charge. Vehicles returned excessively soiled attract a valet charge.
11. The Owner may terminate this Agreement and recover the vehicle at any time if it is used in breach of these terms.
12. This Agreement is governed by the laws of Jamaica.
