Trade-In Agreement

Records a vehicle accepted by Petrolex in part exchange, the allowance credited, and the customer's warranties about the vehicle traded.

1. The customer is the sole lawful owner of the vehicle traded in and has full authority to transfer it.
2. The vehicle is free of any lien, charge, hire-purchase or other encumbrance, save any lienholder disclosed in section 4, which will be settled from the allowance.
3. The odometer reading stated is the true reading to the customer's knowledge and has not been altered.
4. All material defects, accident damage, flood damage and outstanding traffic tickets have been disclosed.
5. The allowance is based on the condition assessed above. Petrolex may re-assess or withdraw the allowance if the vehicle is delivered in a materially worse condition, or with materially higher mileage, than recorded here.
6. The customer will deliver the certificate of title, registration, both sets of keys where available, and any service records, and will sign the transfer documents on request.
7. Risk in, and responsibility for, the traded vehicle passes to Petrolex on physical delivery and acceptance.
8. The customer indemnifies Petrolex against any claim arising from a breach of these warranties.
