Petrolex makes reasonable efforts to ensure that vehicle descriptions, photographs, mileage, specifications, pricing, availability and other information are accurate.

For imported or auction vehicles, certain information may originate from suppliers, auction houses, inspectors or exporters.

Vehicle availability is subject to change until a vehicle has been secured or purchased.

3. Vehicle Orders

Submitting an order through the website does not necessarily mean that a particular vehicle has been purchased or reserved.

An order becomes binding when the applicable agreement has been accepted and the required payment or deposit has been received and confirmed, subject to any additional conditions stated in the agreement.

4. Imported and Special-Order Vehicles

Customers ordering vehicles from overseas acknowledge that vehicle sourcing may involve Japanese auction houses, exporters and other suppliers.

Availability, auction results, shipping schedules, inspection timelines and port processing may be outside Petrolex’s direct control.

If a selected auction vehicle is not successfully purchased, Petrolex may work with the customer to locate another vehicle meeting the agreed specifications and budget.

5. Pricing

Prices may be displayed in Jamaican Dollars (JMD), United States Dollars (USD), or another clearly identified currency.

A quotation should specify what is included in the stated price.

Unless expressly stated otherwise, customers should not assume that an advertised or estimated price includes every third-party charge, government fee, tax, customs charge, port charge, registration cost, insurance cost, or other expense.

The applicable written quotation, invoice, order form, or sales agreement controls the final transaction.

6. Deposits

Vehicle orders may require a deposit.

For transactions subject to Petrolex’s 30% deposit arrangement, the required deposit will be calculated against the applicable agreed vehicle price unless a different amount or payment schedule is stated in the customer’s written agreement.

Deposits may be used toward vehicle acquisition and associated transaction costs once an order has been authorized.

7. Cancellation and Refunds

Cancellation and refund rights depend on the stage of the transaction and the customer’s specific sales, consignment, or import agreement.

Where Petrolex has already purchased, secured, bid on, shipped, or incurred non-recoverable expenses for a vehicle at the customer’s authorization, some or all amounts paid may become non-refundable or subject to applicable cancellation/restocking charges as provided in the signed agreement.

Any 20% restocking/default charge applies only where it forms part of the customer’s applicable agreement and is legally enforceable.

Nothing in these Terms is intended to exclude or restrict rights that cannot lawfully be excluded under applicable Jamaican law.

8. Payment

Payments must be made through payment methods officially authorized by Petrolex, which may include:

• Bank transfer
• Cash
• PayPal
• Other approved electronic payment methods

A payment is not considered cleared until Petrolex confirms receipt of cleared funds.

Customers are responsible for ensuring that payment details and transaction references are correct.

9. Payment Security and Fraud Prevention

Petrolex may verify transactions before accepting or processing an order.

Suspicious, unauthorized, incomplete, or potentially fraudulent transactions may be delayed, declined, or referred for additional verification.

10. Shipping and Delivery

Estimated shipping and arrival dates are estimates rather than guarantees unless expressly agreed otherwise in writing.

Delays may arise from circumstances including vessel schedules, port congestion, weather, customs inspections, supplier delays, regulatory requirements, or other events outside Petrolex’s reasonable control.

Customers will be provided with available shipping updates where applicable.

11. Vehicle Inspection and Condition

Used vehicles naturally vary in condition according to age, mileage and previous use.

Where available, customers should review vehicle photographs, inspection information and auction documentation before authorizing a purchase.

Minor cosmetic wear consistent with the age and mileage of a used vehicle does not necessarily constitute a defect.

12. Trade-In Vehicles

Where Petrolex accepts a trade-in, the customer represents that they are legally entitled to transfer the vehicle and must disclose any applicable lien, loan, encumbrance, accident history, material defect, or other relevant ownership issue.

A trade-in valuation may be revised where previously undisclosed material information or defects are discovered before completion of the transaction, subject to the applicable agreement and law.

13. Customer Responsibilities

Customers are responsible for providing accurate:

• Personal information
• Contact information
• Vehicle specifications
• Identification documents
• Payment information
• Trade-in information
• Delivery and registration information

Petrolex will not be responsible for delays or additional expenses directly resulting from materially inaccurate information supplied by a customer.

14. Electronic Documents and Communications

Customers consent, where permitted by law, to receiving quotations, invoices, receipts, agreements, order confirmations, shipment updates and other communications electronically.

Electronic records may be retained as part of Petrolex’s official transaction records.

15. Website Accounts and Security

Where customer accounts are available, customers are responsible for safeguarding their login credentials.

Customers should immediately notify Petrolex if they believe their account has been accessed without authorization.

16. Intellectual Property

Petrolex’s website design, company branding, logos, graphics, original photographs, documents and other proprietary content may not be copied, reproduced, modified, distributed, or commercially exploited without authorization, except where permitted by law.

Third-party trademarks remain the property of their respective owners.

17. Website Availability

Petrolex may modify, suspend, update or discontinue website functions where reasonably necessary for maintenance, security, upgrades, business changes or other operational reasons.

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Jamaica.

Disputes shall be subject to the jurisdiction of the courts of Jamaica, except where the parties lawfully agree to another dispute-resolution procedure.

Petrolex may amend these Terms periodically. Updated Terms will become effective when published on the website unless otherwise stated.

Changes will not retroactively alter a completed transaction where doing so would be unlawful.
